Hello sathiharu, I need your suggestion on below situation, Currently I am on H1B visa and working as an IT consultant (contractor). indian employer-> Vendor -> Client. Both vendor and client are very good and kind of big firm. Recently I have got TPS EAD and would like to use it. So I am thinking to leave my indian employer and just be an employee of the vendor and work for the same client, that way I may get little more money per hour. I am little bit hesitate to directly talk to the vendor, as they might tell this to my employer and in future if I need something like GC filing then that indian employer may not file GC on my behalf. Is it possible to switch to the vendor without letting know the current employer? Please give me some idea how can I move to the vendor by replacing my indian employer? Thank you!

To answer your question in short, in most cases, it is not possible to switch directly to vendor without the knowledge of your current Indian employer because they have non-competitive clause between the Indian consultancy and the middle vendor. You also mentioned the vendor is big, so big companies don't do things illegally like the notorious Indian consultancy. First, find out if the vendor really hires on EAD, most of them I know do on GC, not sure if they will entertain you on EAD, so if they don't, then, it is the end of story. If they do, you will still need a no objection letter from dhoti bhai to switch to vendor. Remember, big vendors, real companies don't do underhanded things. If you do succeed in convincing and switching then most likely you will rescind a nice relation with Indian consultancy and when you need a GC sponsorship you might not get one from them. In addition, vendors might hire you but still not sponsor your GC. Your primary goal should be to get GC as soon as possible. Paisa bhanne kura pachi pani kamauna sakincha. Gud Luck.

Thank you panacea for the nice advise. Looks like I better don't talk to the vendor on this matter. Actually my indian employer is not filling GC now..they have said they will file but may be after 2-3 years..near to the end of my H1B. So I think its time to move on to another company who is ready to file GC soon.
