 B2 visa extension???

I have efiled and sent supporting documents for the B2 visa extension for my parents on Dec. 1 and received the receipt . I havent heard anything from USCIS since then.My parents visa ends on Feb 6. I heard USCIS will take more than their processing time. So can my parents stay until heard from USCIS or they have to leave country before Feb 6. Any help will be appreciated.

I have the similar situation. My sister in laws visa has already expired (Dec 24th 2008) but applied for extension on Oct. 15th 2008. Status still says pending. Requested extension up to 20th Jan 2009. What should I do? Should I ask her leave and submit 1-94 + receipt number of requested extension at the airport?


THis is so confusing.

I know someone who filed for B2 visa extension. The form was sent to the USCIS(in June) about two months before I 94 expiration date(August). USCIS sent the receipt right away, but did not make a decision until about four months after(December) the original I-94 expiration date(August).
While the application was pending the person was in the US. So in December, they sent the new I 94, which made her eligible to stay in the US until February.

The processing time that is shown on the USCIS webpage is not so accurate, and hence cannot really be relied on. The decision came way before the estimated date according to the website.

But to my knowledge one can stay in US even after your I 94 has expired, if you file for the extension about 45 days before I 94 expiration date, and it is being processed. There will not be any problems  later if the extension is approved. However, they might only approve three months of stay the next time you visit.
If it is denied then the person has to leave the country within a short period of time(10 or 30 days not sure) and the multiple entry visa will be void.

Agnt10, you are right that once you file visa extension, you can stay until you hear about approval or denial of your extension from USCIS eventhough your I-94 has expired and it is still considered legal stay. Yes, if it's denied, you might have a very short time to leave the country, But I am not sure if the person has multiple entry visa, that's going to be cancelled for next visit.


Has anyone been in this situation? feed back pls.
