Nothing will happen unless you were involved in some serious crime. DUI isn't a minor crime itself but it shouldn't affect you upon your arrival at the airport.

Having said that, should you be eligible for Citizenship in the long run, it could take a toll on your application.

Hey Gairikhet,

You might be in some trouble if you were:

1) Taken to jail and they took your fingerprint.
2) Did you already go to the court, if yes what was the verdict?
3) Do you have a valid visa? If your visa is expired and you need to get a new visa to enter the states then it is advised that you travel at your own risk.

I was arrested for driving with a suspended license, which I was unaware of. Was taken to jail, and they took my fingerprint at the same time. I went back home, with an expired visa. While returning I visited the consulate general to get a new visa. When in the embassy my fingerprint matched and was asked to bring additional documents e.g. court documents from the US and police record verifying my background check was clean. This whole process took me over a month and was lucky to get the visa. If you need a new visa and are going back home then from my experience I would not recommend you doing that. Plus your case is more serious than mine.

All the best and hope things work out.....

You were charged with DUI and weren't taken to the jail? That is kind a surprising. Is it a DUI charge or DIP? Do you have a lawyer or were you appointed one by the Court? What happened at the Arraignment hearing or when you were taken to the Magistrate’s office? What code section are you charged with and what State do you reside in?
