Hi Guys:

I am in need of help regarding the procedure for filing GC. I am in H1-B and working as a consultant.
Now, if I get married with US citizen , what will be the procedure and how long I have to wait to get GC.
Any suggestion will be appreciated.

You will get your conditional GC in less than a month after you file it.

That is conditional GC you will recieve. And after 21 months of valid marriage, again you need to apply for independent GC - in which you need to provide valid proofs e.g. shared bank accounts, etc etc. Then you will get independent GC.

In this mean time, if your marriage fails before 2 years, there is high chance of you loosing GC. However, if you can prove that the marriage was geniune one but did not work, you are still able to get GC. Go to state department web, download pdfs, fill it in, and send along with required fee.

what is Conditional GC meant for? Would I be able to work legally for any employer having this kind of status?
What will be my H1-B situation?
Can i go home for the certain time having this conditional GC? Please furnish me the details.

Conditional GC is a "temporary" Card issued before you'd be handed a permanent one.


If your marriage is genuined ( you might need to prove it ) and you divorced before the conditional terms ended, you'd still be able to apply for an independed one.


Yes, you can go home w/ your conditional GC. But, if you were to leave the country before you were issued a GC, you'd require a valid Travel document to enter. Good luck man.

Well,
After marriage, If I will submit all genuine documents(this is going to be a true marrige with nepalese US citizen.), how long I have to wait to get the GC.Can I work independently after getting conditional GC?
