Nepali Congress (Democratic) president Sher Bahadur Deuba and former minister Prakash Man Singh, the Royal Commission for Corruption Control (RCCC) on Tuesday has awarded a jail sentence of two years and a fine of Rs 90 million each.

Deuba should have got a jail sentence, no doubt, but for a different reason... effectively handing over the power to the palace. Paap kahan bata karauncha? Dhuri bata ... Deuba and the royal family are just playing hide-and-seek.
Girija should be next, I agree.

Some people seem to think it is OK to jail Deuba even if he is not guilty (after all he has been guilty of other things right?) just to make an example of him to other corrupt or would be corrupt officials. This is laughable to me. If he is guilty of something else, try him for that. And remember that 5 other people have been caught up in this. Is it fair that in a bid to nail Deuba, 5 innocent people also have to suffer? The setup of the RCCC itself is ridiculous - the same people investigate, prosecute and then provide the verdict. How in the world can anybody get a fair trial in such a farcical setting?

hello Republican,

I too denounce Gyanendra in the way he is handling politics in Nepal. But that does not mean I will have to support corrupt leaders and let them do corruption again. they are equally responsible for this mess as much as gyanendra is..

Now coming back to Deuba's case, I feel like laughing at your face to term them innocent. With what prove are you terming them innocent, they cancelled a valid contract and awarded the same contract in double price to another contractor. there is no ground to prove them innocent...

One beurocrat commited suicide of shame because of getting indicted in this case as far as all remaining are concerned they are all equally responsible.. no one is innocent..

It would be sad if RCCC stops here it should indicte all the corrupt leaders, that will clear path for Corruption free republic nepal... one day we will establish republic nepal and then bring Gyanendra, Paras, Prachanda and Babura to trial.. right now they think they are above law.. but no one is ..... Day will come when they will pay for their deed...

BTW if you are saying they are innocent based on ADB's report, no INGO's and Banks in ktm are above corruption, they are there to benefit from political crisis....

Moreover, ADB chief said the decision might have been made based on soem other information that ADB's comission did not have access too, so he is ready to review ADB's report after seeing the detail of RCCC's verdict...

Moreove, comission was equally right about not considering ADB"s report as evidence for its judicail inquiry, because AdB's commision was a private commission formed by ADB which has not affiliation with nepalese govt and judiciary. If you start considering those report as evidence then you have chaos all around..

Tommorow when girija is brought into trial , congress will form a comission and produce report he is innocent.....

Moreover ADB also had benefits from Deuba's decision, because they will be able to give double the amount in loan so will be able to collect double the interest...

At least ADB had a report and an investigation. At least ADB's report says why a new contract had to be awarded. Where is RCCC's report? Based on what evidence did they imprison 6 people?

Every contract awarded is a valid contract. It would'nt have been awarded otherwise. There are a thousand reasons why a contract has to be terminated and a new one is needed. Do you know the reason why this was the case in melamchi? No you dont. No one does. Because the RCCC has not told anybody about it. They have just imprisoned 6 people and not told anyone why.

Corruption! Thats why we imprisoned them. Cause they were corrupt.

The people who are expressing their dissatisfaction here are not doing so because they think Deuba wasnt corrupt. They are doing so because whether corrupt or not, a due process has to be followed for everything.

Republican is not supporting Deuba. He is supporting his and your rights.

He is supporting your right to walk freely on the streets knowing that nobody can come arrest you and put you in jail and shoot you without any proof, evidence and investigation as long as they say frankenstein is corrupt or frankenstein is a terrorist.

You are right. If you start considering report from not just ADB but *any* commision not affiliated with nepalese govt and judiciary, we will have chaos.

This is positive action. This kind of action must have been taken by Nepalese 45 years ago. We would not have serious problem in Nepali government, political, Social, law and orders and development.

RCCCs decision is not based only on its report, it has conducted the investigation, it took statements from everyone related. You can shout foul from staying outside nepal, go back to nepal and talk to general public member they will tell you what was foul play there....

If it was not corruption why did one person suicide of embarassement, why are Deuba and Prakash manshing afraid of fighting against the case, they know they are guilty and they can not win... they are just trying to get away with it in the name of Gyanendra's authoritian rule...

Above all you just look at the property they have accumulated from that itself even a dumb bling person can tell how head to toe corrupt they are.. and it goes for all most every politicians and beurocrats...

Though I am against this cabinet I have no sympathy for Deuba or Prakash Man, I consider this as at least one good job done by Evil Cabinet

It is sad that history gave us two great leader like BP and Ganesh Man but they could not teach leadershipt to their own family....

- How do you know he committed suicide out of embarrassment? Do you even remember his name? Do you know how he was involved? Do you know that he was not one of the six involved?

- They have said they will challenge the decision in the supreme court. Until then one cannot assume they are afraid of fighting against the case.
Also, when you are older, you will realize that fighting doesnt just mean punching each other. You will find ample statements about why they decided not to fight the commission but instead to fight in the supreme court.

Above all you just look at the property they have accumulated from that itself even a dumb bling person can tell how head to toe corrupt they are.. and it goes for all most every politicians and beurocrats...

- Once again. remember what I and others said earlier about due process and civil rights and right for a fair trial and all that good stuff. Why were they not charged by Akhtiyaar? Why was the case of corruption not brought forward in the Supreme Court.

For a person who knows nothing about the case, you sure seem to spew forth information as if you know them to be facts. What you've said in the few posts so far have been exactly what's been published in the newspapers in the past few months, so its quite clear you're just repeating what you've read or heard in the news.

Let me comment on some of your remarks:

Yes, the initial contract was cancelled but the contract wasn't arbitrarily awarded to somebody else at jacked up prices. The contract was awarded after a new bidding process. If the winning contractor had the lowest bid among the new bidders, it doesn't matter how high the prices were compared to the previous bidders.

This is a good example of you reading a news snippet a few months ago and so confidently using it to justify the current fiasco. I know you're talking about Dinesh Pyakurel, who committed suicide in June. You probably read that he was the former executive director of the Melamchi project and immediately came to your conclusion. Pyakurel was the FORMER executive director and he was replaced before even the FIRST bidding process was started. And he wasn't never connected to the current case, let alone be indicted for it. I don't know where you're getting these weird ideas from.

ADB has every right to investigate any wrongdoings in this project because it is the primary donor (pledging $120 million) and has every reason to make sure that its money isn't falling into the hands of corrupt individuals. That's why I believe the ADB when it says it hasn't found any evidence of corruption in this case. Let me tell you something. The ADBs and the WBs prefer working with the current government setup because it's more centralized and apparently less bureaucratic. If they has discovered any wrongdoings, I'm sure they would have no qualms in divulging the facts.

Yes, they could be corrupt and they could've amassed property from other shady deals. I'm just talking about this case. If Deuba has tons of property, it doesn't necessarily mean that he got money from the Melamchi project, does it? Your assertion hardly proves anything.

There is the suicide story again. Please read what I wrote above about that. Deuba and Prakash Man Singh were not afraid of fighting the case. They knew they would be pronounced guilty no matter what the facts were. They adopted the 'political vendetta against us' strategy which seems to be working since the people in the streets are riled up.

I hate it that it seems like I'm in bed with Deuba, protecting him from the big bad wolf. I actually don't like the person and don't think he was ever fit to be the Prime Minister of any country. But I sure as hell won't buy this whole RCCC thing. I'm mad at the process and this whole Shakespearean drama.

Lazywally, I share your sentiments. I don't understand how people can call this a fair trial just because they're mad at Deuba for being an incompetent Prime Minister.

So far this looks to be a political revenge drama ... like in Mexico, like in russia
like in many un-democratic countries..... I am not convinced that why Deoba?
alone. Why not Mr. P for the death of Gitkar or taxi driver.....

Deoba surely deserves the penality that fits his crime. But, others who did
crime (lets start from top: Mr. P) .......... should not be left unnoticed.

I will certainly see in near future that Deoba will be released free after appeal
goes to one level up ..... as if he is 100% innocent.... It will happen after
President's Bush's aides in Nepal, (US ambassador) pressurize King G against
the case. We should not forget that Deoba is the first elected PM of Nepal
to enter Whitehouse in US and Nepal's history. Deoba is also a staunt supporter
of Bush's international alliance of that 30 or so countries. To make that 30,
Deoba's contribution is certainly important to US whatever may be Nepal's
economic role in the world. Bush once notices that Deoba is in jail, he will
tell ambassador directly or indirectly to find ways to release him. Then, the
appeal in higher court will release him free and give clean chit.... it will happen
because at this time too, all these decisions were made just to steer the
current political scenes to elsewhere .... make people engage in such filthy
stuffs.... while King G strengthens his position and changes other rules
and regulations .... succeed to exclude the parliamentarians....

In any sense, Deoba will be freed.............. because of his support to
President Bush's Iraq war. Thats bottom line, King G can not keep him
long in Jail. Once relased, Deoba will be prized for PM ship... Afterall,
King G's current ministers are mostly having corruption or some scandals
still in pending in court ....

King G has appointed all these corrupts without any real or very real portfolio
in the ministry ... just to divert public attention on what he is doing inside the
palace. So that people keep on engaging on talks on these corrupt ministers
starting from tulsi to jagat gauchan...... and they will not spend real time to
find whats going on inside the power house.......

I also agree with Gp's points. This seems definitely a revenge to the political leaders. The so called Shahi Commission accused Deuba to give the contract to another party while existing contractor was working on that....
But gimme air man, if the existing party just finish 13% of whole job in a year then the main financer has a right to give the job to the new one.
For example, if you are not doing your work properly and always have attndance problem in your work and if you haven't reached the half of the target job, then your employer will definitely fire you and give your job to another qualified person.
I think this act as a mere revengeness to the politicians.

How about Madhav and Girija Koirala? Are they clean with Melamchi Project, Khanepani and Dhal Nikas, Hydro Electricity projects, Highway Projects?

I would not have convicted them if I was re-writting whats published in media, I was in nepal recently and it was from talking to people around there I found out what was going on..

as far as giving contract to new builder is concern, I guess it is not just mere coincidence that contract value gets increased my double and contract gets in the hand of builder who is party member and financer or NC-D.....

Yes, republican you must feel bad that you are supporting Deuba sleeping on same bed...

My point here is we should denounce gyanendra's cabinet but in the mean time should not loose our check against political leaders, they should be punished at every chances we get..

but as GP pointed out I dont think Deuba will ever server 2 years and government will ever get back their 9 million.. its sad but its true.....

I just want to clarify one thing to Frankenstein that Jip c. Lama, whom you are hinting at got the smallest percentage of contract. Bigger parts went to Sharma and Co. and a chinese company called CCECC. What is RCCC doing for them?

Well, what is RCCC going to do about peter giri and other kg's kuttas? This asshole giri and k bista got 10 lakhs for "repairing kitchen" and take special allowance 3 times their salaries. and it seems RCCC doesn't care about willful bank loan defaulters as long as they are ready to be kg's dog. Ministerial quarters and PM's residence are vacant, but this asshole giri lives in his friend's house and Nepali people pay for him.

Deuba and co. were jailed just for saving RCCC's (that means kg's) face to show that it has done "something". And where in this world can you see the same body arresting, filing the case, investigating and deciding, all by itself? (And all those 3 guys who decided, do they have any legal background? I know for sure that the chairman of this so called AYOG doesn't even have any distant relation with law enforcement). It used to be happen only in medieval times in other countries and until rana regime in Nepal. It seems Nepal is being taken to 1000A.D. by kg.
