I am just writing this because, some of the comment here is not correct. It could screw you if not properly planned. I have first hand experience based on exact same situation and messy legal battle in Nepal of family member.

The fact is if you are Nepali citizen and your wife is also Nepali citizen, then you are screwed based on neplease law. She has full right to claim your property in Nepal regardless of what you do. When I say your it's just not directly on your name but also those which you have right based on inheritance. It will going to be long legal battle and it usually ends in settlement, but by law she has right over 50% of your property. She can't claim anything you have here in neplease court but property in Nepal she can claim and she will win legal battle if she has resource and paitence/time to fight for it.

Divorce and property division/claim are generally separate matter. It's lot easier to get divorce here but she can claim property in Nepal, even if you get divorce here. If you try to get divorce in Nepal, they will mix both property dispute and divorce together.

You need to plan this carefully, depending on how much property you have in Nepal. The best option is to come to some aggrement with reasonable number, otherwise no matter what you do, she can claim and will win battle if she has time and desire.

I would recommend to plan carefully not act too quickly on it.

Just wondering! If she had finished divorce process here, on what grounds she will file case in Nepal. She gotta do simultaneously if not what grounds a divorced gal will file case in Nepal- she is already divorced. Divorced in one country is divorced in other country, similarly marriage in one country is marriage is other country. Few years ago it was different, but now it have changed. You know all marriage being done for dependents and all to fly Australia. Nepal’s court must side with decision made by the American court. I’m sure there are lawyers who make money in the fear of losing wealth.

You may wish to consult an attorney in the foreign country to determine if your U.S. divorce decree would be recognized there. Most U.S. embassies and consulates have lists of lawyers on their websites that you may use as a resource to locate a lawyer in that country.
