HOUSTON—A 25-year-old Houston man was charged with three counts of intoxication manslaughter late Monday in a crash that killed three teenage girls last week.


Prosecutors say Sajan Timalshina was drunk behind the wheel of a Toyota Camry when he ran a red light and smashed into a Ford Excursion on July 9.


The crash occurred around 1:30 a.m. as Timalshina was headed north on the Highway 59 feeder and the SUV, which was carrying two adults and five teenagers, was headed east on the Sam Houston Tollway feeder.


Two of the teen passengers – 13-year-old Avianca Cortez and 17-year-old Rashaunda Raleigh – were ejected from the SUV and died at the scene.


A third passenger, 13-year-old Detrihanna Davis, died the next day at the hospital. They were not wearing seatbelts, police said.


The other occupants of the car were taken to the hospital in serious condition and have since been released.


According to court documents, Timalshina failed field sobriety tests at the scene. When police asked for a voluntary blood sample, Timalshina refused, but officers were able to get an involuntary sample because the accident was fatal.


That sample was taken at Ben Taub about three and a half hours after the crash and registered a blood-alcohol level of 0.075, police said.


After performing a retrograde analysis of the sample, officers determined Timalshina’s blood-alcohol level at the time of the accident was between 0.127 and 0.162.


In Texas, a person whose blood-alcohol level is 0.08 or higher is legally intoxicated.


According to court documents, Timalshina gave a voluntary statement to officers after the crash, saying that he was driving his brother’s Camry, had worked a 16-hour day and was confused about where he was going because he was tired.


Timalshina told officers he’d seen a green light farther up the road and mistakenly thought it was the nearest signal when he ran the red light and hit the SUV.


In a second statement, Timalshina told police he’d had a 12 oz. Corona at his brother’s work just before 1 a.m., but he’d only consumed a fourth of the beer.


Police said a big-rig driver, who waiting at the red light at the time of the crash, saw the whole thing.


"When the light turned green, he noticed that the Toyota Camry traveling north was traveling at a high rate of speed and he felt that he wasn’t gonna stop so he stayed where he was at," said HPD Sgt. I. Izaguirre. "But the Ford Excursion didn’t see that car..."


One of the surviving girls, 14-year-old Necie Davis, described herself going in and out of consciousness after the crash.


"I felt the car hit the other car and then after that I just blanked out and when I kind of looked around and Avianca Cortez was laying on top of me and I was trying to see if she was still here," said Davis. "I was trying to get her up, but I couldn’t really move."


Davis, who was released from the hospital late Friday, said she and her friends were on their way home from a party when they were hit.


"We always went places with each other," said Davis. "I wish I could see them one last time at least. I didn’t get to tell them I love them or anything."


Timalshina's bond was set at $150,000

[And I find it particularly funny that the only form of argument most of these pro-hanging or pro-lifelong sentencing people know is that "why don't you go to Nepal?". You oppose hanging? Why don't you go to Nepal. You oppose the way they appoint jury here? Why don't you go back to Nepal. You oppose death sentence? Why don't you go to Nepal?. You like the fact that criminals are to be kept in jail to reform them? Why don't you go to Nepal? Is that all you guys know, folks?]

Oh, yea. Did anyone read about the new report from Bhadragol Jail? The attempt made to improve the life of inmates inside the jail has been lauded by many, including in Kantipur Daily.


I rest my case here folks. I hope you enjoy hanging the drunk driver, now that you all seem to sure about his guilt ....

drunk driver face who takes away lives of 3 people? In your opinion how
many years do you think this guy should be sentenced to?

 aaba houston ma khaire harule naramro nazar le herne bhayo. the peopel there are uneductaed and poor so they don't like foreigners at all, if u r not white or black they will treta u like a crap, even the children born from illegal parents will treat us like crap. anyways tyo marne haru chai mexican ko bacchaharu jasto chani.

those who died lets check their status too, i think they were anchor children born from illegal parents, one of the black dude who speaks spanish from either honduras or colombia, who knows, at  least this timilshina was legal and it was just a mistake made in the wrong place at the wrong time

Look at this moron Racist sunsweesh; I wonder how and why nepalese want to be related or associated to the animals like sunsweesh and Ajay dev. 

Justice here are appointed by president; how about in Nepal? Are the justices in Nepal neutral? The most corrupted institution in Nepal are associated with Law and order; Police and justice department are the most corrupted. We have a vice-president that has been convicted of corruption.

Perhaps we want this kind of justice:
-Home minister abuses his authority to save the gang rapist police personnels (his relatives) who raped their own colleague.
-In another article posted on sajha today said Girija got a bribe of 10s of millions rupees to withdraw the case of criminals.
-Sujata and Makune abused their authority by withdrawing a case against the alleged terrorists namely Dhamala and gang despite the evidence of phone-conversation.
-Police personnel saved to arrest the child-rapist, father of Upendra Mahato, and perhaps he is never going to be captured.

or wait! we love vigilante justice. Just look at what happens after every accident. Are only the public to be blamed for burning the vehicles and beating the driver? Had there be a good justice system to punish the drivers, would public still be taking law on their hands? Hundreds of fatal accidents happen every year in Nepal and have anyone thought how many of these even get charged? May be many of them are repeated offenders. Just this week, I was reading about another fatal accident by Swayambhu Yatayat; and guess what the driver didn't even have a valid driving license; his employer said it's not his job to verify it. All we know is to play a blame game. 

Again, I am not trying to defend american justice system; it is far from perfection and has got obvious flaws and many people have been wrongfully convicted as everywhere else whether it be based on personal interests or non-intentionally.

I strongly oppose the capital punishment, and gladly Nepal doesn't have the one. This is what I like the most about Nepali justice system.

What you said is reasonable. But note that I didn't say Nepal's penal system is flawless or that it doesn't suffer from the influence of politicians;sure prime minister and home minister pardon their man and you can buy off judges and that I am disgusted by it.(for the record, both Bill Clinton and George Bush pardoned their cronies and donors at the last minute,as you know. And Illinois governor was trying to sell senator seat. He got caught, but every Chicagoian knows that the state and city is full of shitty politicians.).

I defended two things about our penal system: one is its relatively shorter incarceration period, its belief that jail systems are there to reform people. I hope some people do comparative study on recidivism of these people and see if our system has worked. I really would love to know whether people released late in their life commit crime again and again in Nepal?

Another is our emphasis on doing away with capital punishment. Prime minister Bhim Shamsher was actually the first person to abolish capital punishment (except in the cases of treason, sedition ), and it has been so long. 

Yes, the recent spate of violence  by insurgent groups have made a mockery of these laws, but the good news is that once parties enter the mainstream they agree with this fundamental principle.

For your record: our country didn't give the world words like lynching, chain gang and so on. Our country is darn poor, but there are some things about it that is worth emulating even by the richest countries.

[As for Ajay Dev sanga associated hune kuro chha, I don't know who you are talking about. I have only one consistent position in this thread: that I think american lengthy prison system is barbaric, cruel and doesn't serve any purpose. Show me one statistical work that says that it is efficient in doing what it purports to do. It is not me saying this, it is the great minds/scholars of this country saying this.]

no i like the American law system, you can bail out , post bonds, even the jail here is better than some of the houses where Nepalese live, nepal law system  is [Disallowed String for - bad word]ed up,not good at all, corrupted brahman officials, we need a change, that Timilshina dude should be caught and extradited to US, also that guy who stole lottery. i am not mean person but u know blame the illegal immigrants in Texas, all these Mexicans because of them everybody thinks that all foreigners are illegal, and to be honest omg those kids born from illega immigrants they r responsible for crime and drugs and innocent people like us caught at the midle of racial tension

Sajan is responsible for taking those three lives. He can not live the rest of his life peacefully with the sin he committed, he is already punished. Bringing him back to the US cannot bring those lives back, let him live his life.

this guy had so much time to run away from the country. ain't that good enough law. all suspects are innocent until proven guilty on the court of law. pire: dont you think thats good enough law.

I can't believe just he is nepali , some of y ou are supporting him.  He should be brought to justice according to the american law.   Accident's can happen to anybody. You  or me. But at least you should cut out the risk.  Don't drink and drive.

Drinking and driving is a murder. I feel for those three lives.  At least if SAjan timilsina is put into the bar , the victims family will get some solace.  Or else it will be anohter blow to the family. 

somebody said that he didnt' kill those people intentionally.  I mean tell me, how many murder is done intentionally with killing motive.  Most of the murder that takes place in the world are just a result of non intentional fight.  The fight does not have killing motive. but still somehow one ends of dying. 

If somebody drinks and drives and kills, he is a killer simple as that.  

Please don't support him being a nepali.   I remember when last year one american diplomats car hit some nepali guy in kathmandu everybody jumped calling for the heads of that american.  Everybody should be brought to justice whether that is that american or nepali.

I just hope that Mr. Drunk Driver does not run over your stupid a.*ss next time you go back to Nepal, where he would probably evade whole hassle of being penalized by bribing his way out, and would not even have flee to another country...

Justice will be prevailed and should be prevailed.

We are tangled on Justice system in US and Nepal to some extent every judicial system is manipulated within it's boundaries but the degree varies. Someone is trying to prove Nepal's system is better, hell not, it is directly influence and criminals are out. Crime is part of our new culture, Underground and over the ground.

may be it is dragged far from it's periphery/contest.
