Hi Friends,
I'm working on TPS EAD at the moment, and was wondering if GC sponsorship is possible without going through H1B. There are mixed opinions out there even between different immigration lawyers (based on avvo.com answers). However, theoretically it looks possible based on what USCIS website says.
If there is someone out there who has been in the same boat; is in the employer sponsored GC process while on TPS, or knows someone who is, it would be really nice to get the first hand experience opinion.

Yes, you can apply for green card on TPS if your company is willing to sponsor you. But you can't be illegal before TPS to use it. In that case you can't to Adjustment of Status here and has to go through the embassy, in which case there is a slight chance that you may be denied. You don't need even H1B but TPS has to be approved that's what my lawyer told me.

One can adjust the status if the entry was inspected...contact USCIS for basic info and then contact good lawyer do processing ...

I am doing this right now.

I'm on F1 and TPS now and applying for PERM.

There is statistics published about what status someone was on before their sponsorship. It was about 90% or more on H1B but it can be on any status.

In fact, the PERM sponsorship application can be done even without the person being present in the US.

There is a lot of bad advice out there because most consider the India/China case which has a long wait list to get green card and only makes sense through H1B. Also, H1B renewal is dependent on PERM which is also step for green card sponsorship and causes more confusion.

Also note that it takes 1-1.5 years to get through the process until the green card.

Luckily, my TPS was approved while I was in status (in non profit H1b), so looks like adjustment of status won't be a problem. But most of the companies I talk to, don't wanna do GC on TPS. Freaks 'em out.
@m00se if you don't mind, would you inbox me the name of your employer? May be they can save my a** too

moose, it would be a big help if you could inbox me the name of your employer, so I can look at my options. I am in a similar situation right now and want to change status to perm asap.

Wow!! I just clicked on the link and found a company called MSA Alliance filed for Green Card for one of their workers while on TPS for a salary of whopping $363,000. An employee at West Virginia University got his/her GC filed while on TPS for a salary of $240,000. Wow!!! Milne raichha ni yaar. Yo ho ni ta vitamin bhaako kura. Thanks Cicada bro. :)

That guy making $363,000 was probably a surgeon from Syria. No wonder the pay looked good. Lol.. Good for him/her.
