 H1B stamping, mexico or nepal?

Guys/Gals,
        I'm thinking of getting my h1b stamped but not sure weather I should do it in Nepal or Mexico.
I was pretty much sure that  I'll do it from Mexico but just got to know from my lawyer that if i get  denied, I wont be able to come back to US.
Any suggestions? Or is anyone going to get their visa stamped this year from Mexico/Canada/Nepal?

Oh yeah, I could schedule appointment in any mexican or canadian cosulate, is there a way to schedule an appointment in nepal us embassy? I went thru their site but couldnot find .

Help much appreciated !!

Trips to Mexico, Canada & Adjacent Islands

To facilitate entry into Canada or Mexico as a visitor, you must carry all the documents listed above except for a valid F-1/J-1 visa stamps for some students. In addition, a visitor's visa may be required depending on your country of citizenship

F-1/J-1 students or their dependents who are planning a trip to Canada or Mexico should contact the respective consulate offices to determine whether a visitor's visa to the country is needed prior to your trip.

Re-entering the U.S. from Canada on Expired F-1/J-1 Visa

Many students may travel to Canada, Mexico and Adjacent Islands and re-enter the U.S. on an expired F-1/J-1 visa if the trip does not exceed 30 days. (Referred to as Automatic Revalidation) Citizens of Iraq, Iran, Syria, Libya, Sudan, North Korea, and Cuba are not eligible for this benefit and must be in possession of a valid F-1/J-1 visa to enter or re-enter the U.S. at all times.

We are talking about H1 here. not F1 and J1.

Your previous F1 visa expires the day your OPT starts (I think the day you graduate), even if there is still F1 visa time left in your passport.

When you join the college after you completes your OPT,  then your status will be F1 automatically.

Has anyone been able to secure a visa appointment in Mexico?

I am having a hard time. The dates are never available. Any recommendations???

Got confirmation that NABIL will allow to schedule  appointment for December only on November.
I think we've got a month's window. Jamma 3 weeks ko chutti cha paine ho ki hoina...

I am crossing from Tijawana in Jan (conformed). And as of right now, I am trying to see if I can take victor garcia's help and cross from TX. However, its not open for Nov yet. Hope to get a stamp by Nov last week.

Hey guys i am going to Nepal in Nov and i took 6 week vacation for h-1 b stamping too.. Does anyone have ever heard abt h-1 being rejected in Nepal. I have not heard of any cases like that rather hv heard some rejection in Canada and mexico as things are pretty tight these days especially for consultancies. I got a genuine job but i am pretty scared.. Just wanna confirm if any case have been rejected in Nepal ..

And what kind of questions they are asking these days in Nepal.. And what is teh complete documents ??

dont worry, you will be fine.  if you have a genuine job, have your I 797 with you in addition to transcripts, pay stubs, offer letter and passport.  they might ask you few questions regarding your job and type of job you are doing.  good luck and enjoy your stay in nepal.

Any way these r the docs listed in
 http://nepal.usembassy.gov/temp_work_visa.html

When applying applicant must submit the following:

  • Completed application form
  • Passport valid for travel to the United States and with a validity date at least six months beyond the applicant’s intended period of stay in the United States.
  • One colored photograph
  • A notice of approval, Form I-797
  • MRV receipt (provided by the Bank)
  • Citizenship card

The following documents are required at the time of interview:


-        Approval Notice Form I-797 issued by the USCIS

-        Evidence of Employment in the U.S. (e.g., Job letter, pay stubs etc)

-        Firm Registration Documents

-        Tax documents, if any

-        Prior visas/passports

-        Academic records i.e., transcripts

-        Any other relevant documents

-        Firm registration documents in the U.S. (for L-1)

-        Citizenship card


 I'm mainly concerned about  Firm Registration Documents . Now what is that? Do we need it?

Plus, Siwani could you please let us know the availability of dates once you reach NABIL for scheduling
your appointment.

Here are some scenarios of successful visa stamping, grabbed it from murthy.com

- I did my MS in US ; I am working in US based company in USA; I went for H1B stamping in Chennai consulate
The Visa officer just asked about the nature of job thats all; then finger prints were taken and he said I will get my visa in 2 days

If u have F1 visa in ur passport H1B stamp is easier

Me: Yes.
VO: Who do you work for?
Me: I work for Company XYZ.
VO: So, you did your masters. Where did you do?
Me: ------------------
VO: For whom did you do your OPT?
Me: I worked for the same company , XYZ.
VO: When did you graduate?
Me: I graduated on MONTH/YEAR.
Vo: So, your brother is a PR. How did he get that?
Me: He applied thru his company and got it.
Some more questions she asked. I responded.

VO: How much are you getting paid?
Me: XXXXX
VO: Can you show me recent pay-stubs?
Me: I showed recent 4.
Vo: You are good to go.She took out a red slip and marked "F" 2:15pm there and asked me to come and collect my PP back the next day.

It took around 5 minutes.

I carried all the possible documents needed which includes the following.

These are the mandatory documents which are needed.

1) Visa Appointment letter.
2) Original I-797A Approval form.
3) Passport
4) DS-156, I pasted my photo in the form.
5) DS-157
6) Scotiabank receipt for 131$
7) Employment Verification letter
8) last 4-6 pay stubs

These are the list of documents i had in file, which were not asked for me.

1) Master's Degree original certificate
2) SSN Card
3) All of my previous W-2s and Tax Documents
4) Original Offer Letterfrom my Company
5) I-129 Petition for a Non-Immigrant worker
6) I-129 Supplement
7) Certified LCA
8) H1-B Data collection and Filing Fee Exemption Supplement
9) Petitioner's Letter submitted in support of the I-129 petition
10) More Pay Stubs
11) My School Pay Stubs and all i-20's
12) MS Transcripts
13) Undergrad Degree certificate & Marksheets
14) Bank Documents
15) Company Tax/Revenue Docs
16) Driver's License
17) Company ID/Badge
18) Apt Lease Document
19) OPT Card and I-797 for that.

Officer: Hi ( preetly rudely!!)
Officer: Which school did you go to? (sounds like he got offended after seeing me)
Me: Blah blah
Officer: But you came to a different university?
Me: Yes I transferred my credits
Officer: How long did you study in your xxxxx university
Me: blahblah
Officer: When did you graduate your last university
Me: blah blah
Officer: so what did you do after you graduated
Me: blah blah blah blah blah
Officer: Ok I am giving you visa. Come tomorrow at 2 o clock in the afternoon and pick up your passport
Me: Thanks much!

Definately as soon as i get ther i will go for appointment. most prob .. i will go to nabil bank on 18th Nov adn will update the thread..

I am going in Jan for the same and I am wondering what this FIRM REGISTRATION DOCUMENT  is. Can you please tell me what it is? Do we really need it? And Techie what are you saying? That we have to get an interview date a month in advance? mero ta 4 weeks matra chha. ke garne hola??

Hoina hoina, if I want to schedule a date for December then I can only do it on November bhaneko, we cant schedule a date for December on October bhaneko. So 1 mnth agadi dekhi matrai dates haru available huncha bhanna khojeko. Sorry for confusing you.
Mero ta jhan 3 weeeks matrai.

FIRM REGISTRATION DOCUMENT chai ajhai confusing. Aru site check gareko kahi pani yo mention gareko chaina..kahi nabha jatra hadi gau ma bhanya jasto .

No need original Company ID card , SSN or any cards. If you want, put the photo copy of it. They will take it out and give back to you, if you put the original cards.

Get the copy of all the documents filed during H1 and staple it all (that includes labor approval from DOL i.e your salary verified by DOL) you know what I mean. They did not checked it but I kept it. You might want to take the receipt notice too (the one you get before your H1 petition).

I guess the Firm Registration document means your consultancies' Registration with US gov. If you are directly  hired by well known companies then you won't need it. I did not put this.

ranii, please visit usembassy website of nepal.  you dont need all those documents what these indian forums says.  believe me, its lot easier than people think from here.  4 weeks should be enough if you are going in january.  remember, by that time most of the students or parents who are coming here for their kid's graduation would have already applied for visa. 

what i had during my interview:

H1b approval notice ( I 979)

transcript

offer letter

resume

passport

photograph

you will submit your application in Nabil bank to get the visa interview date and time..

This is the form you need to fill out and give to Nabil bank along with your original passport and H1 petition and Rs. _____. Do it by yourself from some cyber cafe not near embassy else the cyber cafe near Nabil bank will take Rs 100 or more for this form only.

I have a visa from a consultancy company.  I'm planning to go to Canada for my H1b visa stamping. The agency I'm with is a very small company, about 3 consultants. Will that create any problems?

Should be DS-156 only. I think NABIL  will let us know if we need to fill some more docs, so no worries. No  visa issuance fee for H1b. You can take me out for dinner with that money though.
