Hey Is anyone else than me nervous about h1b lottery this year. Got a decent job couldnt file last yr so this is last year to file. I am not in IT field so I guess I have to leave the country if I wont get selected. Time is limited so I guess now it wont be enough for greencard filing as my ead expires on feb 2016 even if I tell the company to file it( not sure if they wud)

Rajan101, I am on the same boat as you are. It does not matter either you are in IT or other, upon expiring your EAD, you have to either leave country or do other things to keep your status ( assuming that you are in F1.) This year also there are plenty of H1B petitions filed and it all depends on luck to get picked on lottery unless your petition is filed for US - Masters CAP ( which they say has more probability of getting picked but not guaranteed though ). So far for green card what my lawyer told is that it takes 12 months to 18 months or could be longer if they audit the petition. She also told me that there is always a risk from OPT to Green card. So she said she will not file my GC until I have my H1B. She rather suggested me to go back to school. Everything I mentioned above is not a legal advice but hope it helps. I would suggest you to cross your finger and wish you good luck . I am kind of nervous too but there is nothing we can do except wait and see. Reg,

Maile pani file ta gareko ho bro haru last week. Kasto mutu dhuk dhuk bhai raako chha. Graduate hudai chhu May maa. IT maa kaam garya 2 years bhai sakyo. Yadi yo H1B parena bhane EB2 bharna paainchha ki paaindaina? Ani ke ke chha byawasthaa EB2 ko?? Yesso koi bro haru ko experience chha bhane please share garnush na hai.. Dhanyawaad.... :)

The earliest one can get EAD card under EB2 (while pending i485) is 11-14 months from the time of prevailing wage determination application provided it is not audited. So h1b napareko condition ma if the employer is ready to eb2 filing and opt is valid for so many months, eb2 is a good idea. But if opt is expiring in few months and STEM extension is not applicable, going to school is the best.

I dont see any difference between eb2 and eb3 now . For eb3 its oct14. I am planning to tell my company to file me in eb3 ( i dont have salary in 60s only mid 50s in civil engg) so eb2 might be difficult. If there's no audit. And perm is approved say at the last week of EAD ( mine expires feb 16) yes am in opt extension, or in grace period ( i guess i have 2 months of it to leave country) . Can I file concurrently and leave the country And come back if it gets approved. Or once i concurrent ly file am i eligible to stay on pending status(140 and 485). ( i know i need ead to work). I would really appreciate if anyone has some info regarding my queries.

By the time ur perm is approved, if ur priority date is current, u can definitely appraoch concurrent application. Once u apply concurrently, u can leave US only if u get Advance parole which will take around 2 months if u apply for it along with concurrent application. Leaving US with pending i485 without advance parole or without h1 is like abandoning i485. The best way in that case is apply i140 premium with consular processing option. Leave US with and appear for interview in US embassy after i140 is approved and after u r informed from the embassy to prepare for visa processing.
