 H1b transfer in 5th year

has anyone done a H1B transfer in their 5th Year after the Labor for EB3 is already approved?? The reason for transfer is that my prospective employer is willing to do EB2 processing. Its a cap exempt institution. Please let me know about the RISKS and CONSIDERATION  this this regard.
