 F2A Priority Date-October Visa bulletin

All,

DOS and USCIS made some changes in the Visa bulletin. Per DOS, the current cutoff date of F2A applicants is 15APR14 whereas USCIS says you can file I-485 if your priority date is before 01APR15. This has made me major confused. Anyone knows what we are supposed to make of this?

Your suggestions are highly appreciated!!

Did you guys start getting notification from USCIS to send I-485? or should we send even with out notification from USCIS?

@thukka: USCIS will not send any nitification, u just file i485 if ur priority date is earlier than the new filing date.

@jantajanardhan: u will not go thru i485, since ur spouse is in Nepal, u still have to go through councelor visa processing. You will get notification from NVC about starting the process when time comes.

Can you point me to the link where it says that the F2A priority date is 01APR15 instead of APR 2014?

I was confused too, go to right below that table
B. DATES FOR FILING FAMILY-SPONSORED
VISA APPLICATIONS

The chart below reflects dates for filing visa applications within a timeframe justifying immediate action in the application process. Applicants for immigrant visas who have a priority date earlier than the cut-off date in the chart below may assemble and submit required documents to the Department of State’s National Visa Center, following receipt of notification from the National Visa Center containing detailed instructions. The cut-off date for an oversubscribed category is the priority date of the first applicant who cannot submit documentation to the National Visa Center for an immigrant visa. If a category is designated “current,” all applicants in the relevant category may file applications, regardless of priority date.
The “C” listing indicates that the category is current, and that applications may be filed regardless of the applicant’s priority date. The listing of a date for any category indicates that only applicants with a priority date which is earlier than the listed date may file their application.

USCIS has determined that this chart may be used (in lieu of the chart in paragraph 4.A.) this month for filing applications for adjustment of status with USCIS. Applicants for adjustment of status may visit www.USCIS.gov/visabulletininfo for additional information.

So, my SO's i 130 is currently being processed (initial review). We have a priority date of jan 2015. Does it mean we can go ahead and send in i485 as well?

You might wanna wait till oct 1st as the bulletin is for October. I am also getting my stuffs ready to send it after Oct 1st.

My priority date is April 14 but not approved yet so my girl friend will be eligible to apply i485. or not and she is here in US.

My priority doc is Sept 19, 2014 for F2A category. I have been waiting for the USCIS visa bulletin date so the date is current. Can i apply for I-485 with this new change in USCIS and DOS published dates. Please advice anyone.. Thanks

@ Rajababu0, yes you can apply now as you PD falls inside the cutoff date per the visa bulletin.

@Gaurav123, Dude sorry to be mean but all you need to do is google. There are hundreds to immigration blogs that have the info. Also ,if you do some due diligence, you can find the information in USCIS website.

My priority date is May 25, 2014 under F2A. I called USCIS today to make sure if I could file for the adjustment of status, but the customer service had no idea about it and said I should file I485 after the visa number is available. So, still confused if we can actually file I485?

Also I have my I130 approved under an old passport, and now I have a NEW passport with a new number, so are we supposed to file with the new passport or old one?

Any ideas would be highly appreciated!
