 H1B extension problem

Hi All,

I don't have client right now. My H1B is going to be expire at the end of september. Is it possible to get my H1b extended without client letter? My consultant company does not  want  to apply for my h1b extension without client  letter .What  should I do in this situation ?Any help or  suggestion would be appreciated.

RC,

These days USCIS is doing lots of check esp with Desi Consultants..Most of the Time RFE is issued with request for Client Letter and what not..

How about finding a real Job..I know in this Job market it's tough but i presume that u already have 3 years of US working experience , give it a try for finding a real Job..Then do the extension of ur H1B..

How about switching back to F-1 if u have 3-4 most recent Valid paystubs..In that way u can buy ur time and Look for a Job without havng to worry about the H1b status..If u get a Job then have the employer file for extension...

Or, you can go back to Nepal until the situation in US becomes more stable..U already have H1b and i presume that u r already counted against the CAP ,so u won't be counted against the CAP again..Find a Job and come back to States...


And don't be out of Status..as u might already know " Until the Employer -Employee Status remains" u will be in status otherwise u r not..

Thanks a lot .I appreciate it. I already stayed 6 months out side of USA after getting my H1B . Is it legal to stay 6 months more after september. My visa expiry date is sep 2009.

When is you I-94 Expiry date?  If ur I-94 expiry date is sep 2009 and if u stay  6 months in USA more then u will be in Serious trouble..it's called Overstay and u may face Potential Ban of 3-10 years from US..
