Hello All,

I need a serious suggestions on this matter, please :

Current Situation :
Right now, i'm on 17 month OPT ( OPT extension period) period and looking for a job. Mero kaam nabhayeko huna le, maile euta consultancy ko help bata mero status maintain gari rakheko chu. 

Now, i'm planning to go back to school again on FALL 2010 for another degree program, so i have already applied for it and going to get a new I 20 soon.. But before my classes get started, i am also planning to going back to Nepal this summer. So Here are my concerns :

: Have any of you guys done something like this before ? 
: Will there be any problems while re entering to US with a new I-20... As i will leave USA while i'm on OPT and will re-enter here with a new I 20.

I already talked to my advisor at school and he said like as long as your visa is not expired, you should be fine with it.

But I would like to make sure with you guys as well. There must be some people who have gone through something like this before..... Please guys give me your genuine suggestion. Your suggestions would be greatly appreciated.

I think you should okay, as long as you have maintained your immigration status and you have a valid visa for re-entry. Just make sure to carry all the supporting documentation during reentry including, all I20s, OPT authorization, financial docs etc etc.

just a quick question:

Don't you have to apply for VISA again in Nepal even if your visa is not expired? I wish to be wrong, but I just want to confirm.

No, We don't have to apply for visa again unless you are out of US for more than 5 months or you here in US but not able to maintain your F1 status for 5 months.

If you are out of US for more than five years or been here but not able to maintain your status for 5 months, your visa get expired automatically.... even though it looks like a valid visa in your passport, it actually will be expired and could not be used to re enter to US.

I have confirmed this with a US consular .

On the Rocks Ji, believe me U are safe and fine 100% on this. The only documents that you need while entering US in F1 status is valid visa and valid I-20. Although it is always a good idea (or say the best thing to do) to carry all the supporting documents (previous I-20) while traveling, the only I-20 u need at the port of entry will be the latest one. While in OPT you have a I-20 valid upto the date of ur OPT expiration date plus few extra time. Now when you get a new I-20, ur previous university (OPT) ( if same college then they don't release you from SEVIS; all they do is issue you a new I-20 with different expertion date) will realease your SEVIS, and a new information is created on the database.


Believe me, at port of entry, an immgration officer doesn't have all time to go through your each and every documents. They have minutes and two. within this period, they check your status on their system,a nd make sure ur visa is valid and I-20 is current. Few will ask you sometimes couple of questions.

I have a quick question.......... Do i need to have a travel signature on my new I-20 from my school/advisor ???

Yes, that is an absolute necessary. It is even mention is USCIS rule for F1 status when you fill ur I-94 card  during the port of entry and also in the I-20 itself. The date is valid for a year (unless rules have changed recently). Even I would consider a letter from International office. They should be happy to write one for you.
